Terms of Service

These Terms of Service ("Terms") are an agreement between you and Traderfyles Inc. ("QastLedger", "we", "us") and apply to your use of qastledger.com, app.qastledger.com and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. Not tax, legal or investment advice

QastLedger is a software tool that organizes your trading data and prepares information and draft forms to help you and your tax professional. We are not a tax preparer, accountant, attorney or financial advisor, and nothing in the Service is tax, legal or investment advice. The tax treatment of prediction market contracts is uncertain and may change. You are responsible for your tax return and for the positions you take on it. Review everything with a qualified tax professional before you file.

2. Accuracy of data

Your results depend on data from third parties, such as Kalshi and Polymarket, and on information you provide, such as CSV files and manual prices. That data can be incomplete, delayed or wrong. We work to calculate results accurately, but we don't guarantee that the Service, your reports or any form it produces are complete, accurate or accepted by any tax authority. Check your reports against your own records.

3. Eligibility and your account

• You must be at least 18 years old to use the Service.
• Give us accurate information and keep your password secure. You're responsible for activity under your account.
• Only connect accounts that belong to you or that you're authorized to use.
• Tell us right away at [email protected] if you think your account has been accessed without permission.

4. Connected accounts

When you connect a Kalshi account or a Polymarket wallet, you authorize us to retrieve your trading data from that platform on your behalf. We only read data and never place trades or move funds. QastLedger is not affiliated with, endorsed by or sponsored by Kalshi or Polymarket, and we aren't responsible for their services, their data or changes to their systems that affect the Service. You can disconnect an account at any time.

5. Plans, payments and cancellation

• Free plan: some features are available at no cost. We may change what the free plan includes.
• Tax Report: a one-time payment that unlocks tax reports for one tax year.
• Pro subscription: billed monthly or annually. Your subscription renews automatically at the then-current price until you cancel.
• Canceling: you can cancel a subscription at any time from the Billing page in the app. Cancellation takes effect at the end of your current billing period, and you keep access until then.
• Refunds: except where required by law, payments are non-refundable. If you believe you were charged in error, contact [email protected] and we'll review it.
• Price changes: we'll give you notice before a price change applies to your subscription.
• Payments are processed by Stripe and are subject to Stripe's terms. Prices don't include taxes unless stated.

6. Acceptable use

Don't misuse the Service. For example, don't:

• break the law or violate anyone's rights;
• try to access accounts or data that aren't yours, or probe, scan or break our security;
• interfere with the Service, overload it, or use automated means to access it except through features we provide;
• copy, resell or reverse engineer the Service, except where the law allows it.

7. Your data and our service

You own the data you bring to the Service. You give us permission to store, process and display it only as needed to provide and improve the Service, as described in our Privacy Policy. We own the Service itself, including its software, design and content, and these Terms don't give you any rights to it beyond using the Service as intended.

8. Changes and availability

We may change, add or remove features, and the Service may sometimes be unavailable, including when a connected platform's systems are down. We'll try to give notice of significant changes that affect paid features.

9. Ending your use

You can stop using the Service and ask us to close your account at any time. We may suspend or close your account if you break these Terms or if we need to for legal or security reasons. Sections that by their nature should continue, such as disclaimers and limits of liability, survive after your account closes.

10. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

11. Limitation of liability

To the fullest extent the law allows, we won't be liable for any indirect, incidental, special, consequential or punitive damages, or for any taxes, penalties, interest, lost profits or lost data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose.

12. Indemnity

If your use of the Service or your breach of these Terms leads to a claim against us by someone else, you agree to cover our reasonable costs and losses from that claim, to the extent the law allows.

13. Governing law and disputes

These Terms are governed by the laws of the United States and the state in which Traderfyles Inc. is organized, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us at [email protected] and try to resolve the dispute informally.

14. Changes to these Terms

We may update these Terms. We'll change the "Last updated" date above, and if the changes are significant, we'll let you know by email or in the app. Continuing to use the Service after changes take effect means you accept them.
